it could be, but you'd want to know how long ago that 10k was, if it was quite a while (say it's been a weekend car or something) then you'd probably want to change it straight away rather than risk it. Scott did that with his first GTI.
The only way to have any comeback would be to complete the sale and pay through Ebay, otherwise you're breaking their rules and they couldn't help you with a dispute. I'm not fully clued up on buying cars through Ebay, maybe someone else will be able to give you better advice
