Driving a car with no mot - Matt - 20-03-2012

Can you actually drive a car with no mot.
If I pick up a car with no mot from London, and book an mot at the garage by my house, would I be able to drive legally? It will have tax an insurence obs Wink

Re: Driving a car with no mot - Scott - 20-03-2012

It's a little bit of a grey area with distance, but if it's booked in and you have proof of this then I would go for it.

Re: Driving a car with no mot - Jonny81191 - 20-03-2012

AFAIK, yes.

I think you can, just got to have proof of where it's booked in.

Re: Driving a car with no mot - Connor - 20-03-2012

Bit of a grey area, but if you got pulled, they might think you were taking the piss a bit... I've been.pulled with my mot out for 2 weeks and didn't get fined or anything, but Id say i was extremely unlucky... and im not taking the piss, but you've had 2 section 59s... they probably wouldn't hesitate to take the car straight off you, as it doesn't matter what car you're in, the section 59 is issued to you

Re: Driving a car with no mot - Kimmie - 20-03-2012

Could you not book it in somewhere closer to where you're picking it up? I'm sure there'd be some recommendations on here?

Re: Driving a car with no mot - Niall - 20-03-2012

No you can't. It's within reason to the coppers discretion. End of the day, who really takes their car 100 miles for a MOT?

Re: Driving a car with no mot - kingy - 20-03-2012

if its booked in for the mot then by law you can only drive it on that day and only to the mot station. saying that ive never heard of anyone just getting done for no mot. last year i drove round for nearly 2 months without mot. oops. my bad.

Depends really, I'd say if you had it booked at Lynx, as they're a specialist of sorts for 306s he might get away with it. That said, I get the impression Mr Matt here is not looking at a 306...

Yeah, Matt's f*cked lol

Re: Driving a car with no mot - kingy - 20-03-2012

just drive it anyway. who gives a toss.

Re: Driving a car with no mot - Niall - 20-03-2012

Other thing is, that specialist thing won't work. Don't forget mot prices are capped and there are no specialist mots. And it's not like you can say that one particular garage does a better job than another.

Re: Driving a car with no mot - Scott - 20-03-2012

True, but most people (the average driver) books their car in for a service and MOT together (doesn't matter how far you drive it in a year, once a year is what is needs apparently lol) so that could swing it.

Thing is they'd probably realise he's trying to get around getting an MOT on it by using that rule.

Safer option: Get the seller to put an MOT on it, and pay extra if necessary.

Re: Driving a car with no mot - Niall - 20-03-2012

Not that I condone it but don't forget i THINK it's only a warning if the not has just run out. Providing there's no section 59s on the car of course ninja

Re: Driving a car with no mot - burnmw - 20-03-2012

No, I spoke to a VOSA guy who said for the "driving to/from a prebooked MOT" to work it has to be booked in to the nearest MOT station. Also, when they ask who owns the car, and you say "I've just bought it..." ?

Re: Driving a car with no mot - Matty - 20-03-2012

Keep driving along, and on the way, keep phoning and booking mot tests at your current destination. Fool proof.

Driving a car with no mot - Matt - 20-03-2012

Gunna get the misses insured to drive back. She has no section 59s lol

Re: Driving a car with no mot - Daniel306 - 20-03-2012

If the car is insured to be driven with no mot or tax, you can drive it as far as you like, aslong as you are going to or from a pre booked mot, i researched this indepth a few months ago

Re: Driving a car with no mot - Grant - 20-03-2012

This ^^^ get someone with traders insurance to drive it for you. Did this with one of my previous cars...

Re: Driving a car with no mot - Dum-Dum - 20-03-2012

I may see if i can find some time tomorrow to dig out the actual rules for this so you can have the letter of the law rather than just opinions, maybe see if theres any stated cases or that.

Re: Driving a car with no mot - Grant - 20-03-2012

Use, cause or permit a vehicle to be used on a road without a test certificate is an offence under Section 47, RTA 1988.
Penalty: Fine of up to £2,500 (if the vehicle has 8 or more seats), £1,000 (otherwise). No disqualification, endorsement or points can be awarded.

Re no MOT invalidating Insurance; Because of section 148 RTA 1988
as to condition of the vehicle, Insurance Companies cannot invalidate a certificate issued as far as making it a criminal offence i.e. to use without Insurance (S145). This does not not however prevent them from taking action to recover certain costs under the civil court.

Cars are not given section 59s, the driver is. The car is irrelevant, I could get one in my car, then drive yours and get another one, your car would be seized as that would be my 2nd section 59, even though it was in a separate car
