Shiply Help/ update need more help :@ - Chris_90 - 11-12-2013

So i went though shiply as recommended by some one on here to get a quote to move the 205 a while ago accepted the offer of one guy, Then the guy let me down at the last minute due to his clutch going. I had paid a deposit of £39 via pay pal, After arranging some one else to move it i text the recovery guy tell him to refund my £39 as i was under the understanding the money goes to him, Well he tells me the money goes to shiply its there commission, so get in touch with shiply tell them the situation after going back and forth all the time with e-mails they have refunded the £39 to shiply credit What is no use to me what so ever as i dont plan on using shiply again.

I have e-mailed them to tell them to refund my money to my paypal account as i dont intend on using shiply again.

So what can i do if they dont do that? can i put a claim in though paypal?

Any help welcome Smile

Thanks in advance

RE: Shiply Help - Tom - 11-12-2013

The delivery guy was right, it does go to them, and they let you down so I can't see it being problem, at the end of the day you didn't use there services :/

RE: Shiply Help - r3k1355 - 11-12-2013

Raise the paypal claim, make sure you raise it quickly because there is a time limit.

Just say you paid for a service and no service was provided, paypal will give you the money back.

Just looking on Google apparently alot of people complaining about same thing Undecided just have to see if I get a reply to the e-mail and if I don't see if pay pal can get my money back

RE: Shiply Help - Chris_90 - 11-12-2013

So these are my 2 options on PayPal

I have a problem with an item I purchased

I want to report a transaction that I didn't authorise

If I click on I have a problem one that then says these options

I haven't received my item.

I received my item, but it is significantly not as described. For example:
The item was damaged or defective.
The box was empty.
The order was incomplete.

This doesn't apply to my problem???

RE: Shiply Help - Danny2009 - 11-12-2013

Just put not received my item then explain the situation

RE: Shiply Help - cully - 11-12-2013

RE: Shiply Help - Chris_90 - 11-12-2013

RE: Shiply Help - Grant - 11-12-2013

As said take it up with paypal.

-The service you placed a deposit for was not of a satisfactory quality as described, or fit for purpose. Despite it being the fault of the delivery driver himself, shiply are the agent sub-contracting the contractor (funny that) and are responsible for the financial re-embursement of a legal tender. Store credit is not a legal tender. The only way they could give you store credit would be as a 'good will gesture' i.e. you broke an item or bought it in error and they are not legally obliged to accept it back. Check consumer rights website, its a good place to start for things like this...

RE: Shiply Help - Grant - 11-12-2013

You know where the button is Wink

RE: Shiply Help - Dum-Dum - 11-12-2013

Yeah as they didn't/couldn't provide you with the service you paid for then they need to refund you and they need to do that in the manor you paid in so as you paid proper money they need to give you proper money. Obviously if you'd paid with vouchers, tokens, club card points youd only be entitled to those back

What do you guys think to this??

If any of you guys are kind enough you write a e-mail back to them for me? and i will send it, Im no good with this kind of stuff will end up just digging my self in a hole Sad

Edit: Looking at there terms and conditions im basically fooked ??

RE: Shiply Help/ update need more help :@ - Piggy - 12-12-2013

Surely that clause doesnt come into effect as you were not the one to cancel?

although those terms do bugga ya a bit

RE: Shiply Help/ update need more help :@ - Dum-Dum - 12-12-2013

IMO that may be their policy but that is not what the law says.

Find the relevant consumer law and quote it back to them. Make sure you have your claim going through paypal already as they will just be trying to use delaying tactics to stop you being able to do a paypal dispute.

I have opened the paypal dispute this is there reply from this.

""From Seller – Shiply Limited12/12/2013 09:36 GMT
We are sorry that you have requested a refund via PayPal. The payment above was for a service and not for tangible goods. We have our own cancellation policies and procedures which you can start by contacting the Shiply support helpdesk at: support@shiply.com. Thanks, Shiply.""

What do i say to that?

RE: Shiply Help/ update need more help :@ - Dum-Dum - 12-12-2013

Tell paypal that shiplys policy is against consumer law and they are refusing to give your money back when you contact them in person.

also it doesn't matter that its not tangible goods, you paid for a service you didn't receive.

RE: Shiply Help/ update need more help :@ - Poodle - 12-12-2013

That's from the seller, not from paypal, doesn't mean anything.

Keep at it mate, they're feeding you horseshit in the hope they don't have to refund you. Just stick to your guns.

Im going to mate will update on when i get a reply, doing it via paypal now not though e-mail so paypal can see the situation

Just hope no one else uses shiply and get this issues.

From Gov.uk here: https://www.gov.uk/accepting-returns-and-giving-refunds

"You must offer a full refund if an item’s faulty, not as described or doesn’t do what it’s supposed to."

But technically they have given a refund, but via the credit thing what is no use to me?

RE: Shiply Help/ update need more help :@ - Connor - 12-12-2013

No theyve given you credit, im sure someone up the thread has posted that it has to be legal tender

RE: Shiply Help/ update need more help :@ - Jenkosowls - 12-12-2013

Chris have you contacted your credit card company yet?

RE: Shiply Help/ update need more help :@ - Dum-Dum - 12-12-2013

Credit that you cant use is pointless and not a real refund.

You want to read here
http://www.moneysavingexpert.com/shopping/consumer-rights-refunds-exchange

and here if you can understand it (from section 12)
http://www.legislation.gov.uk/ukpga/1982/29
